Well it is their country. We are serving through our volition.
We have an expectation, but in a free market it is demand and supply.
i am Not trying to be negative - just a reality check on where we stand and how we can approach.
It is a fact that immigration from Asia shot up at the turn of the millennium. This may look disproportionate to proponents of diversity.
Now 1/6th of the world population comes from one country. But the quota for Iceland and India remains the same.
Consequently many like us cannot: change employers, give up opportunities (lure of which we came here for) and wait for the same outcome that others achieve much faster, simply because they were born somewhere else or their employers & lawyer decided their immigration category. So much for free country and meritocracy.
i believe our main point should be a level playing field and transparent
system so that expectations are clear.
For those of us who have suffered due to lack of clarity, for all fairness, must lobby for a chance to parity after multiple (say 10) years of serving LEGALLY.

Hello Immigration gurus,
I have a very simple question.
When can a person leave the job to work for any employer to do any kind of job (other than one mentioned in the Labor Certificate)?
Choice 1:
6 months after FILING 485
Choice 2:
6 months after GETTING green card
Choice 3:
??

Hey mind your business. You don't know a thing about India and I am sure you wouldn't have even visited once in your lifetime. If you have problem with individuals, companies, sue them find legal ways to stop their wrong doing. It is good for everyone. Dishonesty is not a patent of any country. You show me 10 corrupt people from India, I will show you 100 from UK, 100 from USA and 100 from Japan.. Don't blabber about things you don't know in a public forum. I am taking offense of what you wrote.. You owe an apology to India and people from that country in this forum..
If you are offended, I don't give a DAMN!! I know about India very well and has been to India many a times. I know very well about the indian corruption which has no comparison with any country in the developed world. All you have to look at is the suveys from various NGOs that track corruption at various countries in the world and you can see where India ranks relative to US or UK

Nice to know the film makers comment about our campaign. How about contacting them to get the hundreds of DVDs of 'Lage Raho Munnabhai' and send them to Walter Reed where flowers are going? Just a vague thought, I am sure someone else also mentioned similar thing earlier.

My PD is 01/09/2007. Is there any chance to reach my spot in May visa bulletin? Any thoughts would be greatly appreciated.
Thanks,
Nandu
No. Not in May, but sometimes during 2011 the chances that Jan 2007 will be current is extremely good. Good luck.

Well, no - my basic argument is that the banks bloated up the 'real' asset value - I had the money then and I have the money now and I am still paying my monthly mortgage amount - the point is about the inflated housing prices.....with these banks knowing the actual value of the asset and still going ahead with the extravagant loans.
From another point of view, tell me 1 reason why would you lend out money to somebody who you know would not be able to pay you back?
your argument is weak. You used these 'extravagant loans' knowing that they are extravagant and then signed on the dotted line and now you are backing off saying 'sorry, you gave me a loan on something I wanted and thought what it is worth and it is no more. So take it back'. If you 'have the money now' then pay by all means and don't end the contract that you signed.
I agree banks were greedy. So is punjabi.
And all the argument about returning used goods is no comparison. The bill says that you can return it in a month. Foreclosure is a provision to help people is serious trouble. It is trying to be sympathetic and nice to people who are in pain. It is not something one is entitled to because he couldn't make a profit.

Height of selfishness....
It is amazing that how these people are ready to spend tons of money and time for such selfish causes.
If this kind of enthusiasm is displayed on IV action items and contributions then there would be better chances of achieving the goals of this community.
People who created this forum, which is helping this community so much, have been working for years.. selflessly.. spending time and money and effort many times spending their own money for the causes of this community.. people like Aman, Pappu, Pascal, logiclife et al... There are lots of people in this community who thought about the community first.
If they were like you.. then things would have been worse.
But, if you are so hell bent on putting your GC first, irrespective of the damage to the cause of the community, if you are so mad about yourself.. why do you care about polling.. Go alone.. just focus on "you and your GC" .. achieve something alone.. You can then keep all the benefits to yourself.. all yours..Go ahead!
Just like your campaign, the fundamentals on which you run it, cannot be trusted.. because if it suits you, you'll sell you supporter's interests for your own GC.
That's why you get support from very few....
This forum was created on better fundamentals.. Here community comes first.
That is why IV and those who created this forum have support of thousands!

All due respect for your thoughts. You just want to lie that you will go back? ...and that is thinking differently?
Please dont even bring up freedom struggle into this. Obviously its seems like you know less than what you think you know about it. It will even weaken the point you are trying to make. Gandhi didnt only preach peace. He also preached many other things....speaking the truth for example.
Thinking differently isnt bad. It just came to my mind that this may also be tried.
I think we have proved something like this not very long back about 60-70 years back. We have set bonfires of all our imported clothes and said NO to anything made in Britain. Right. So what did we really mean. I am sure many brands we wear today are international too. Nothing wrong.
Why did somebody show the other side to be slapped, did he like to be slapped. Its to get the point across.
Its a way of protest, a peaceful way to get attention to a problem which must be fixed.
If most of you dont agree, then I may be wrong, lets see response.
But lets always maintain that they do care and its a two way requirement and not just ours. We may be desperate due to system failure, but they are too, else there wouldnt be an immigration program. Most countries dont have, if I am not wrong. Its different with US which is a big country and same is the case with Canada which is trying to build. They need people.

How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.
l1fraud,
I sympathize with you. If your job is getting impacted by this, you have every right to complain.
On a friendly note, you need to upgrade your skill. You cannot survive on just oracle/db development.

Wow.. Applicants are waiting since 2002 and Govt Agency know it but don't do anything. Shame on you FBI NNCP
Check this:
http://www.bibdaily.com/pdfs/Liang%2010-30-07.pdf
Defendants assert that the background check is a complex
process that must accommodate an extremely large volume of requests
from the USCIS. Given the backlog of name-check requests and the
FBIs limited resources, they maintain that the delay of two and a
half years in processing Mr. Liangs background check is not
unreasonable. There is some validity to these points, and the
Court appreciates that the name-check process is indeed complex and
resource-intensive. But limited resources or not, a common-sense
rule of reason dictates that if the FBI was performing background
checks with due diligence, it would not take two and a half years
to process Mr. Liangs name. While the Court is sympathetic to the
demands placed on the FBI and the limited ability of the USCIS to
control how the FBI allocates its resources, a lack of sufficient
resources devoted to name-check operations is a matter for the
agencies to take up between themselves or with Congress. The
executive branch must decide for itself how best to meet its
statutory duties; this Court can only decide whether or not those
duties have been met.
See Dong, 2007 WL 2601107 at *11 ([I]t is
not the place of the judicial branch to weigh a plaintiffs clear
right to administrative action against the agencys burdens in
complying.).
Moreover, although there is no Congressionally mandated
timetable for the processing of I-485 applications, Congress has by
statute expressed its view of what a reasonable amount of time is:
It is the sense of Congress that the processing of an immigration benefit application should be completed not later than 180 days
after the initial filing of the application. 8 U.S.C. 1571.
The Court recognizes that this statute was enacted prior to the
events of September 11, 2001, and that the burdens on agencies with
responsibility for immigration matters have since increased.
Nonetheless, Plaintiffs applications have been pending for five
times the length of the period identified by Congress.
Defendants argue that expediting Mr. Liangs name check will
prejudice other applicants who have been waiting longer than he -in some cases, since as long as December, 2002.
While this would
be unfortunate, Defendants failure to fulfill their statutory duty
to other applicants has no bearing on whether they have fulfilled
their statutory duty to Plaintiffs, and thus cannot serve as a
basis for denying Plaintiffs motion.
While Defendants worry that
granting Plaintiffs relief may reward the more litigious
applicants or encourage other applicants to file lawsuits,
perhaps recognizing this possibility will provide the defendants
with adequate incentive to begin processing [I-485] applications in
a lawful and timely fashion in order to obviate the applicants
need to resort to the courts for redress. Dong, 2007 WL 2601107

I dont see any improvement at chennai.I contacted consulate after 7 working days (after interview) and got reply to allow another 4 work days.
Consulate has handed over the passport to VFS on Jan 2nd and VFS has dispatched on the same day.I would be receiving that today.

You said
"Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??"
My answer:
This is not about forcing USCIS into doing anything. The sole purpose of this is to bring awareness in mainstream media(and in doing so the american public) to the need of reform in american immigration system for skilled migrants. Immigration reform is not just reforming illegal immigration but this is one of our chances to put focus on legal employment-based immigration.
You also said
"My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???"
My answer:
Why should I be embarrassed about protesting how sheer incompenet USCIS/DOS decision making is on this visa bulletin fiasco? about how my tax dollars and my application fees are spent by these departments?
Infact for people to be coming out of thier little cubicles to protest on something they feel is injustice says something about how embarrassed the government bodies should be about thier failure in doing their job. I have no shame in expressing an injustice done to me.
You also said
"Exactly that is now 2006-2007 PD guys are expecting to happen a miracle, right? I mean, apply 485,EAD ASAP."
My answer:
My PD is Jan 2006(been living here since 99). When Visa bulletin became current, my only expectation from it is that my wife can start working on EAD. I don't think anyone who was planning to apply for 485/EAD/AP based on the old july bulletin realistically expected that they would get their greencard in few months. This outrage is only that USCIS/DOS couldn't keep their house clean in how to solve the unused visa numbers and insensitively moved the dates forward and then backward causing emotional strees and hole in our bank balances. They did us wrong and might do it again.

Hello, I can understand your pain as I was in a similar situation as you are. I would recommend to wait for atleast 2 weeks. I interviewed on 28th Dec and finally got the email on 9th Jan and the pp stamped on 10th Jan and took the flight on 12th Jan.
If you have an upcoming travel which is in next week, please try to reschedule it as it is not certain on how much time does it take in such cases.
I do not think getting the employer involved into this will help. VFS office will have no clue on this and they will answer only Questions on the process. Writing to the US consulate will also give you a general answer. It is sad that there is no accountability in cases like these. Please keep the faith.
Can you add which consulate (Mumbai/Delhi/Chennai) you interviewed?
