its ok, you misunderstood my point. I dont want to divert OP of this thread.
Anyways the fact of the matter is that we are in a limbo, all indications point to Obama becoming the next president of US. if CIR 2008 was any indication , we as EB applicants are royally screwed if Sen Durbin dictates his immigration policy. What is the use of talking about wars and innocent people when chances are that the advocate of his immigration policy is opposed to my main issue of EB reform. high low Taxes, 401k's, houses, Medicare etc will matter if you get to stay here in the first place. A average 6-9 years of paying taxes, supporting medicare and Social Security and we now need to think about moving to different countries where skilled immigrants are welcome....think about it. Just look at the CIR 2008 discussion to understand what i am talking about. Read the senators transcripts.

I have a few theories on this. This is meant just to open discussion.
1) The USCIS and State department are not communicating at all. This is not at all uncommon within gov't agencies as we all know.
The State Dep't released the bulletin perhaps without realising the full ramifications. Having heard from the USCIS..........hey hey hey what the F&^% are you doing? They may have realised over the last few weeks what a mess they have on their hands. Now they are trying to undo it.
2) Another possibility I can think of, is that this is a grand plan(heck I almost said grand bargain) concocted by the USCIS to get 485s OUT of the system as much as possible while minimising those that can get IN. Hence you might see in the coming few weeks thousands of approval letters all dated the 2nd of July. That will allow them to clear their backlogs of pre-approved, approvable cases and clean the slate fresh for the new fees structure/new quota in the new year. Some of you might remember they retrogressed to unavailable around this time 2 yrs ago. They do these weird things in the 4th quarter.
3) Of course the last option is their brains have the same IQ as that of any common critter that messes up your garden.
Pick your poison, it is all the same. I feel for everyone whose hopes were raised so high. It is truly inhumane of them. If they planned this, they should atleast have delayed the release of the July VB.

Yup, that was my point - both are greedy :)....so no point blaming any 1 party. And agree with you that foreclosure is only an option if you 'really' can't pay your monthly dues and that too for a sustained period of time - if one has the money to pay the monthly mortgage, one should continue to pay it off even if the asset value as plummeted to rock bottom because that is what you have singed in for - the amount of loan you took out to buy that house. No excuse from that!

NSC sent me a response that my GC got lost in mail as I raised a SR for card. My wife got CPO but I got a letter from USCIS NSC that my card was sent on the same day my I-485 approval notice was sent which I think is some mix up on USCIS and to file I-90 . I got all letters from USCIS but not this one so I called customer service and talked to 2nd level IO who went through my case and said card was never created. She will raise a new SR for that which was on 10/12/2010

Only thing I know is that if you come before me in the line I am affected. It is not a DMV line where every one will get their License, it is a ration line where the items are limited.
Call it selfish call it any thing else but these are the facts after being in the USA for last 12 years and two different labors.
You have every right to look after yourself. But it should not be at the expense of your comrades who are affected by this unjust system more than you are.
Solution: direct your ire against the system that is unjust to you. ( USCIS, DOL, Gov etc). That is what IV is trying to do. Let them give enough visa numbers for EB based applicants.
If many of the great leaders of the world were as selfish as we are, we would all be a herd of animals.

DISCLAIMER - I am EB3-I with PD of 01/2007 AND I am not porting to EB2....
I DO NOT support this law suit idea but I really admire SunnySurya... not because he/she is planning to file lawsuit but because he/she has been really polite and patient to so many insulting, taunting and name-calling posts "personally" against him/her.
Again, I am NOT supporting actions of SunnySurya..... but admiring the patience and politeness....
My first and last post on this thread... hopefully... :)

What the employers are doing seems illegal. Govt issues us this card for a lot of money, and now we can't use it for work?
I agree. I was wondering why legal needs to be consulted for EADs.
But then this company is fully aware of of EADs and AC21 requirements. I think legal gets involved to ensure job codes are matching, etc., which would make sense. The applicant may not have completed 180 days, may be applying for a different job code, etc. They do invest a lot of money on an employee during the first year and they obviously do not want to end up losing that investment due to immigration issues, something they can avoid.
But this is something I was not aware of until today. The good thing is most employers are receptive to EADs which is good.

Except for waiting for a visa number to be available all other delays are due to the time that it takes to process a case (and also due to the country quota). In labor stage, DOL determines if there is any citizen who fit in the labor description and who is looking for a job. In 140 stage, USCIS determines if the company is in good standing and has the ability to pay. In final stage, the candidate’s biometrics is taken and his background checked. All these are essential process in adjudicating a GC case in the employment category. I just do not how all these can be surpassed and candidates handed over a GC, let alone citizenship.
Allocating recaptured visa numbers and following a sensible order is more practical in eliminating some of the delays…

In response to this event, Academy Award Nominee Vidhu Vinod Chopra, who produced the run-away successes "Munna Bhai MBBS", and "Lage Raho Munna Bhai" stated, "Mahatma Gandhi has influenced several personalities, including American Civil Rights Leader Martin Luther King, Jr. These young, law-abiding professionals have set out to strive for reform the right way- the Gandhigiri way."
The theme of �Lage Raho Munna Bhai� centers on the usage of non-violent principles to win over difficult and non-co-operating entities. In the movies, character Munna Bhai wins over the tough Dr. Asthana by means of chain deliveries of flower bouquets. The sequel has revived Gandhian principles and popularized the concept of Gandhigiri- literally meaning a symbolic act of peaceful protest across South Asia and the UK.

The best way to overcome what you think is unjust, is to protest peacefully. Be nice to your opponent and let him see your point of view. I was absolutely pissed off with the "local" ppl that got greedy and dragged the whole economy with them. Seeing that there are ppl like you (one of us) who are pretty much the same, i am seething with rage. Because of idiots like you, people with a pristine credit history of more than ten years and some saved money cant buy a decent house in the bay area (and elsewhere) and have to see their hard-earned money go down the drain in 401k and stocks.....I wish ppl like you rot in foreclosure hell and no one ever lends credit you, ever again!!!

if it was an ideal situation..then one can sell his house within couple of months..
but because of this American dream, big homes, nice cars, which a person cannot afford, we are in this mess..
Btw.. i would say you would be one of the lucky ones right now who can afford a nice big house which you could not have imagined to afford couple yeara ago because of this housing crisis.. i dont really understand why you are complaing and getting "pissed off with the "local" ppl that got greedy and dragged the whole economy with them"

Over the past couple of days I have had 10 of my friends/colleagues who have signed the letter and they have been mailed out to the president. I also have copies of them to mail out to IV once I have all that I can get..
I plan to call my Senators & Congressman's office's today too. I believe we need to get through to our friends and colleagues and talk about the issues in this letter. I have yet to come across one person who does not agree that our situation needs the attention of the administration.
I know I can get a few more of these letters signed by the end of this week.
Anyone out there who has more letters going out??:D

I plan to call my Senators & Congressman's office's today too. I believe we need to get through to our friends and colleagues and talk about the issues in this letter. I have yet to come across one person who does not agree that our situation needs the attention of the administration.
I know I can get a few more of these letters signed by the end of this week.

Hello,
I'm on H1B and eligible to file I-485 (PD Apr'04 , I-140 approved) and my son was living with us (me and my wife). He joined undergraduate course in Canada in Sep'2006. He visits us frequently and he is 19 + years old and got Canadian PR. I asked my attorney whether I should file I-824 form to transfer his case to Montreal, Canada? But attorney suggested to file for AOS since he will age out once retrogression starts again. All three of us have I-94 dated Jul'06 when we came from India and does not require to get new I-94 since he visits us frequently driving through Buffalo,NY. Now my question is related to form g-325a:\
1. What should he write in applicant's residence in last five years? Should he indicate that he is not living in US or living with us?
2. What should he write in applicant's employment history? Should he write school/college name?

I have contacted Napolatino also, like a month back and nothing has happened on my case. I saw LUDs on my case on 09/24 and 09/25 and since then I have not seen any updates. I have tried all methods that are on that link, except for contacting the first lady but I am not sure if that will help. They simply might throw the package in the trash, without even seeing what it has. I posted the link so that everyone knows different ways of contacting USCIS, atleast you feel good if you try everything from your end.

So lets say Husbands 485 gets deined for some reason and the wife has an approved I 140 but her PD is not current any more, can the substiution still happen or are the couple doomed?

Thats correct. I came back from India yesterday and i used H1 but my wife used her AP to enter at the POE.
Thats the right way. Probably I should not have told him that I have AP in my hands. This is what my attorney said. But now I have no idea if my h1 will be extended or not once I have used the AP.

a) the value/benefit of the name check process is undecided.
b) lack of resources and funding to process all the name checks.
(premium processing will provide those funds)
immigration relief like recapture, more visas etc require congressional approval and i dont think we will see any till mid 2009 after the election is settled.

Just a thought. I think something is holding back folks to write up these letters directly to president. Do you guys think it's a good idea just to have these letters mailed to IV and then pass it along to white house administration when IV meets them.
Those who are against IV and have never supported or never wanted to do anything just make it a point that they will NEVER do it. The reason they give will be a "Silence" or a "change in topic of discussion".
Pessimists will say "Nothing will happen" or "So did you get your GC? after the rally?"
